Terms of Service for FishRoom

1. Acceptance of Terms

By creating an account or using the FishRoom mobile application (“FishRoom”, “the Service”, “the app”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use FishRoom.

These Terms form a binding agreement between you and the operator of FishRoom (“we”, “our”, “us”).

2. Description of the Service

FishRoom is a mobile application for aquarium hobbyists. The Service allows you to:

  • Track aquarium tanks, water parameters, fish, plants, invertebrates, equipment, and maintenance tasks
  • Maintain a journal of your aquariums with photos and notes
  • Browse a catalog of aquarium species and their care information
  • Identify species using AI-powered image recognition (Lens)
  • Connect with other aquarium hobbyists through the community Lounge — posting, commenting, following, liking
  • Access educational content through interactive guides

We may add, modify, or remove features at any time without prior notice.

3. Eligibility

You must be at least 13 years old to use FishRoom (16 in the European Economic Area, or the age of digital consent in your jurisdiction, whichever is higher). If you are under the age of majority in your jurisdiction, you may only use the Service with the involvement of a parent or guardian.

By using FishRoom, you represent that you meet these eligibility requirements.

4. Your Account

Account creation. To use FishRoom, you must create an account using a valid email address. You are responsible for:

  • Providing accurate, current account information
  • Maintaining the security of your password and account credentials
  • All activity that occurs under your account
  • Notifying us immediately of any unauthorized access to your account

One account per person. You may not maintain multiple FishRoom accounts for the purpose of evading restrictions, manipulating community features, or impersonating others.

Account deletion. You may delete your account at any time through the in-app Settings menu. Account deletion is permanent — your tanks, posts, photos, and other data will be removed in accordance with our Privacy Policy.

5. User Content

Your content remains yours. You retain ownership of all content you create, upload, or post to FishRoom — your photos, tank data, journal entries, profile information, Lounge posts, comments, and any other material you submit (“User Content”).

You grant us a license to operate the Service. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to store, host, display, reproduce, distribute, and modify your User Content solely for the purpose of providing and operating the Service. For public content (Lounge posts, comments, profile information), this license includes the right to make it visible to other FishRoom users.

This license ends when you delete the content or your account, except where we are legally required to retain it or where copies persist beyond our control (for example, cached copies on other users’ devices, or screenshots taken by other users).

Your responsibility for your content. You are solely responsible for the content you submit. You represent and warrant that:

  • You own or have the necessary rights to submit the content
  • Your content does not violate any third-party rights (copyright, trademark, privacy, publicity, or other rights)
  • Your content does not violate these Terms or any applicable law

6. Acceptable Use

You agree not to use FishRoom to:

  • Post content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, hateful, or otherwise objectionable
  • Post content that depicts animal cruelty, illegal animal practices, or content that promotes harm to aquatic life
  • Impersonate any person or entity, or misrepresent your affiliation with a person or entity
  • Post unsolicited advertising, spam, chain letters, or promotional content
  • Post content that infringes any patent, trademark, trade secret, copyright, or other intellectual property right
  • Collect or harvest information about other users without their consent
  • Use automated systems (bots, scrapers, crawlers) to access the Service except as expressly permitted
  • Interfere with or disrupt the Service or servers connected to the Service
  • Attempt to gain unauthorized access to other users’ accounts, our systems, or related networks
  • Reverse engineer, decompile, or attempt to extract the source code of the Service
  • Use the Service for any commercial purpose not authorized by us
  • Circumvent any rate limits, access controls, or other technical restrictions
  • Use the Service in any way that could damage, disable, overburden, or impair the Service

We reserve the right to remove content and suspend or terminate accounts that violate these rules.

7. Community Features

Lounge and community interactions. The Lounge is a space for sharing aquarium content with other FishRoom users. By posting publicly, you understand that:

  • Your posts are visible to other FishRoom users
  • Other users may screenshot, reference, or comment on your posts
  • We do not pre-moderate content but may review and remove content that violates these Terms
  • You can report content or users that violate these Terms through the in-app reporting feature
  • You can block other users to limit their interaction with you

Reporting and moderation. We may, but are not obligated to, review and remove content or suspend accounts at our discretion. Repeated violations may result in permanent account termination.

8. The Lens Feature (AI Identification)

FishRoom’s Lens feature uses third-party AI services to identify aquarium species from photos you submit. You acknowledge that:

  • Lens identifications are best-effort and may be incorrect
  • You should not rely solely on Lens for decisions affecting the health of your aquarium or its inhabitants
  • Photos you submit to Lens are sent to third-party AI providers as described in our Privacy Policy

9. Guides and Educational Content

FishRoom provides educational content about aquarium keeping. This content is provided for informational purposes only and is not professional advice.

  • Aquarium keeping involves living animals; outcomes vary by species, water conditions, equipment, and many other factors
  • We are not responsible for outcomes resulting from decisions you make based on FishRoom content
  • For health concerns affecting your fish or other aquarium inhabitants, consult a qualified aquatic veterinarian

10. Intellectual Property

Our content. The FishRoom app, including its software, design, logos, text, graphics, interactive guides, catalog data, and other content (excluding User Content), is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial purposes, in accordance with these Terms.

You may not:

  • Copy, modify, distribute, sell, or lease any part of the Service
  • Use FishRoom branding, logos, or trade dress without our written permission
  • Use any data or content from the catalog or guides for commercial purposes

Feedback. If you provide us with feedback, suggestions, or ideas about FishRoom, you grant us the right to use them without restriction or compensation to you.

11. Third-Party Services

FishRoom uses third-party services to operate (cloud hosting, error tracking, AI identification, etc.). Our use of these services is described in our Privacy Policy. Your use of FishRoom may be affected by the availability and terms of these third-party services, over which we have limited control.

12. Modifications to the Service

We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

13. Termination

Termination by you. You may stop using the Service and delete your account at any time.

Termination by us. We may suspend or terminate your account at our discretion if:

  • You violate these Terms
  • We are required to do so by law
  • We discontinue the Service
  • Your account has been inactive for an extended period
  • For any other reason we deem appropriate, in our sole discretion

Upon termination, your right to use the Service ends immediately. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitations of liability, and dispute resolution) will continue to apply.

14. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT:

  • THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE
  • DATA WILL BE PRESERVED WITHOUT LOSS
  • THE SERVICE WILL MEET YOUR REQUIREMENTS
  • ANY ERRORS IN THE SERVICE WILL BE CORRECTED
  • INFORMATION IN GUIDES, CATALOG, OR LENS RESULTS IS ACCURATE, COMPLETE, OR RELIABLE

YOU USE THE SERVICE AT YOUR OWN RISK.

15. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF (OR INABILITY TO USE) THE SERVICE.

THIS INCLUDES, BUT IS NOT LIMITED TO, ANY HARM TO AQUARIUM INHABITANTS RESULTING FROM RELIANCE ON FISHROOM CONTENT, IDENTIFICATIONS, OR GUIDANCE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED US DOLLARS ($100 USD) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above limitations may not apply to you. In such cases, our liability is limited to the greatest extent permitted by law.

16. Indemnification

You agree to indemnify, defend, and hold harmless us and our affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use of the Service
  • Your User Content
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property or privacy rights

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Washington State, USA without regard to conflict-of-law principles.

Informal resolution first. Before filing a formal claim, you agree to try to resolve disputes informally by contacting us at the email address below. We will work in good faith to resolve disputes for at least 60 days before formal action is taken.

[Optional: Arbitration clause / class action waiver] — These require specific legal review and vary by jurisdiction. Recommend you consult a lawyer about whether to include them and what form they should take.

18. Changes to These Terms

We may modify these Terms at any time. When we make material changes, we will notify you within the app or by email. The “Last updated” date at the top of these Terms reflects the most recent revision. Continued use of the Service after changes means you accept the updated Terms.

If you do not agree to the updated Terms, you must stop using the Service.

19. Miscellaneous

Entire agreement. These Terms, together with the Privacy Policy and any other policies we publish, constitute the entire agreement between you and us regarding the Service.

Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

No waiver. Our failure to enforce any provision of these Terms does not waive our right to do so later.

Assignment. You may not assign or transfer your rights under these Terms. We may assign our rights without restriction.

Force majeure. We are not liable for delays or failures resulting from circumstances beyond our reasonable control (natural disasters, war, government action, network failures, etc.).
